"Shop Your Way Partners" are third-parties (including their websites) that are designated by Company as Shop Your Way Partners, including, by way of example, third party merchants, restaurants, or service providers, who provide Points either through an agreement with Company or through their participation in a network that has an agreement, directly or indirectly, with Company. "Qualifying Prescriptions" means prescriptions filled at Shop Your Way Merchants Pharmacies; provided that the following are excluded from the definition of Qualifying Prescriptions: (A) prescriptions paid for in whole or in part by state or federal healthcare programs, such as, by way of example, Medicare Part D, Medicare Advantage, Medicare Part B, Medicaid, or TRICARE; (B) prescriptions filled by Shop Your Way Merchants Pharmacies located in AR, MA, NJ, NY, Guam and the Virgin Islands; (C) prescriptions for controlled substances filled by Shop Your Way Merchants Pharmacies located in LA; or (D) any other prescriptions which Company or other Shop Your Way Merchants, from time to time in their sole discretion, may elect or be required to exclude based on any applicable laws or regulations or for any other reason. Layaway items purchased at Shop Your Way Merchants after you become a Member will become Qualifying Purchases only when you make your final layaway payment. Types of Points
