Eazelyf offers information and a means to obtain Food services offered, which may be requested through phone application and / or Site, or through any other channel made available by Eazelyf for 'booking' purposes. Eazelyf Site also permits booking of Food services offered by it. All services provided by Eazelyf to You by means of your use of the booking channel, for booking purposes, are hereinafter referred to as the "Service". Eazelyf may store the information provided or record your calls for contacting you for all Service related matters. You may promptly inform Eazelyf on any change in the information provided by you. The Service allows you to send a request through Eazelyf network. The Eazelyf has sole and complete discretion to accept or reject each request for Service. If the Eazelyf accepts a request, Eazelyf notifies you about the same. Eazelyf shall, upon receiving the booking request from You in the manner set out here, proceed to confirm or decline the booking based on the availability of items at the booking time, which shall be informed to You vide an SMS and email. In the event the booking is confirmed, you shall check the booking details including but not limited to delivery time and delivery place, and if there is incorrect detail, the same needs to be informed to us immediately by calling us. You shall bear the consequences and damages for any delay that may be caused to You due to Your failure to check the confirmation SMS/email or failure to inform Eazelyf of the incorrect details immediately. You may choose to pay for the food services by either of the following two methods: Cash payment: Cash payment towards the price after the completion of delivery can be made to the bearer. In addition to the price, any toll duty, inter-state taxes, cess etc. as may not be included in the price but payable to any third party for undertaking the services under Applicable Law ("Additional Charges"), shall also be payable by You. You are responsible for the timely payment of price and Additional Charges, in cash to the bearer. Online payment: Online payment for services can be made to Eazelyf through any of the payment methods offered on the Site. When you choose to make an online payment, Eazelyf shall collect the price and will be responsible for providing the services. Eazelyf will not be responsible for any errors by the Payment Processor in any manner. Further, even in cases of online payments, all Additional Charges shall have to be paid by you in cash, to the authority or person concerned or if already paid by the Eazelyf, to the Eazelyf. If you choose online payment, you must pay for your order before it is delivered. To ensure that shopping online is secure, your debit/credit card details will be encrypted to prevent the possibility of someone being able to read them as they are sent over the internet. Your credit card company may also conduct security checks to confirm it is you placing the order. Any payment related issue, except when such issue is due to an error or fault in the Website or Application, shall be resolved between you and the Payment Processor. Eazelyf will generate the invoice, which will be sent across to your registered e-mail. Please note that the charges mentioned in the invoice are exclusive of the Additional Charges. All issues, opinions, suggestions, questions and feedback while availing our Services may be communicated to us through email address mentioned on the Site or Application. You agree to be fair, accurate and non-disparaging while leaving comment, feedbacks, testimonials or reviews on or about the Services. In case of a late delivery, the delivery charge will neither be voided nor refunded by Eazelyf. If you fail to accept delivery of Food Delivery and/or Goods at the time they are ready for delivery, or we are unable to deliver at the nominated time due to your failure to provide appropriate instructions, or authorizations, then such goods shall be deemed to have been delivered to you and all risk and responsibility in relation to such goods shall pass to you. Any storage, insurance and other costs which we incur as a result of the inability to deliver shall be your responsibility and you shall indemnify us in full for such cost. You must ensure that at the time of delivery of Food Delivery and/or Goods adequate arrangements, including access where necessary, are in place for the safe delivery of such goods. We cannot be held liable for any damage, cost or expense incurred to such goods or premises where this arises as a result of a failure to provide adequate access or arrangements for delivery. We may cancel a contract if the product is not available for any reason. We will notify you if this is the case and return any payment that you have made. You must notify us immediately if you decide to cancel your order, preferably by phone, and quote your order number. If we refuse cancellation, e.g. because preparation of Food Delivery has been completed and/or delivery personnel has already been dispatched, it may not be cancelled. We will not be able to refund any order, which has been already dispatched. If the cancellation was made in time and once we accept your cancellation, we will refund or re-credit your debit or credit card with the full amount within 14 days, which includes the initial delivery charge (where applicable) which you paid for the delivery of the Goods or the Services, as applicable. Reporting of any issue needs to be within 2 (Two) days of the happening of the issue, failing which, such issue will not be addressed. Eazelyf shall endeavor to respond to your issues within 2 (two) working days of Your reporting the same and endeavor to resolve it within 10 (ten) working days. It is hereby clarified that issues are resolved on severity basis, and certain may be resolved earlier than the other. However, Eazelyf shall not be liable for any damages or losses in the event you are not satisfied with any such resolution. We shall not be liable for any failure to perform any obligations under this User Terms, if the performance is prevented, hindered or delayed by a Force Majeure Event and in such case our obligations under this User Terms shall be suspended for so long as the Force Majeure Event continues. By accepting these User Terms and using the Service, You agree that You shall defend, indemnify and hold Eazelyf and their affiliates, their licensors, and each of their officers, directors, other users, employees, attorneys and agents harmless from and against any and all claims, costs, damages, losses, liabilities and expenses (including attorneys' fees and costs) arising out of or in connection with: (a) Your violation or breach of any term of these User Terms or any Applicable Law or regulation, whether or not referenced herein; (b) Your violation of any rights of any third partyor Your use or misuse of the Application or Service. When You use the Website or send emails or other data, information or communication to us, You agree and understand that You are communicating with Us through electronic records and You consent to receive communications via electronic records from Us periodically and as and when required. We may communicate with you by email or by such other mode of communication, electronic or otherwise. Eazelyf reserves the right to change its Fee Policy from time to time. Any contract for the supply of Food Delivery from this website, you agree to take particular care when providing us with your details and warrant that these details are accurate and complete at the time of ordering. You also warrant that the credit or debit card details that you provide are for your own credit or debit card and that you have sufficient funds to make the payment. Food Delivery, Goods and Services purchased from this Website are intended for your use only and you warrant that any Goods purchased by you are not for resale and that you are acting as principal only and not as agent for another party when receiving the Services. When booking from this Website you may be required to provide an e-mail address and password. You must ensure that you keep the combination of these details secure and do not provide this information to a third party. We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the Website. The total price for Food Delivery, Goods or Services ordered, including delivery charges and other charges, will be displayed on the Website when you place your order. Full payment must be made for all Goods dispatched and Services provided. Payment has to be made in cash or, if available on the website, by online payment, e.g. credit or debit card. Delivery periods quoted at the time of ordering are indicative only and may vary. Goods will be delivered to the address designated by you at the time of ordering. Failure to pay on time will result in the cancellation of your order. These Terms and Conditions and our Agreement shall be governed by and construed in accordance with the laws of India.
